A Summit County man is being held at the Justice Center in Cleveland after the shooting death of a parking lot attendant in downtown Cleveland in what one official said was a dispute over parking in a handicapped spot.

Matthew K. Warmus, 25, of Green, was arrested by Cleveland police after the shooting at a parking lot at East Ninth Street and Sumner Court, Cleveland police spokesman Sgt. Sammy Morris said.

Dead is David J. Williams, 27, of Maple Heights.

Warmus, a graduate of Green High School and a college student, was being held on suspicion of aggravated murder but had not yet been charged, officials said Saturday.

Warmus and a female acquaintance pulled into the lot near Quicken Loans Arena and Erieview cemetery about 7 p.m. Friday, about 30 minutes before the Cleveland Cavaliers-Indiana Pacers game, parked and paid Williams, Morris said.

''The two men began to argue over the parking spot and money,'' Morris said. The argument escalated into a physical altercation, with the men pushing each other, he said.

''The two men separated and the arrested male went to the trunk of his vehicle and pulled out a handgun,'' Morris said.

Warmus is accused of firing the gun three times. The victim was hit in the left ear and twice in the stomach.

Morris said Warmus then put the handgun back into the trunk of his car.

He was arrested at the scene.

Williams was taken by EMS to MetroHealth Medical Center, where he died, Morris said.

Williams also had a handgun, according to Morris. That weapon was never fired, officials told the Cleveland Plain Dealer.

A coroner's spokesman said Williams was shot in an argument over a handicapped space.

Powell Caesar of the Cuyahoga County Coroner's Office said the assailant wanted to park in a handicapped space but Williams refused because he did not have a handicapped sticker.

A person who answered the phone at the Warmus residence in Green declined comment when contacted by the Beacon Journal Saturday afternoon.

CLEVELAND: Cleveland police have charged the Summit County man accused of fatally shooting an attendant who refused to let him park in a handicap space without a sticker.

The aggravated murder charge was filed Monday against 25-year-old Matthew Warmus of Green.

Authorities accused Warmus of shooting 27-year-old parking lot attendant David Williams Friday night before a Cleveland Cavaliers game.

Warmus faces a court hearing this morning. Court records don't reflect an attorney representing him and calls at a phone listed for his address in court records went unanswered.
